Termination of the obligation to work out, without reimbursement of expenses incurred at the expense of budgetary funds related to training, occurs:
1) in connection with the performance of work-out duties;
2) in connection with the death of a student (young specialist), confirmed by the relevant documents;
3) in case of disability of the first or second group during the period of working out;
4) in connection with the release from the obligation to work out.![](/public/img/logo.png)
The following are subject to re-distribution:
- persons who have not entered the residency on the basis of a state educational order, master's degree or doctoral degree;
- persons who returned after military service;
- persons dismissed on the grounds of liquidation of the employer or reduction of the number or staff of employees;
- persons whose vacant jobs are not retained by the employer;
- persons who were not hired due to the referral of several young specialists to one vacancy;
- doctors in the profile who were not admitted to the interview or did not pass the competitive selection for the vacant public position;
- persons who did not arrive at the place of distribution within the prescribed period for valid reasons (illness of a young specialist or close relatives, marriage and change of residence, force majeure circumstances that served as an obstacle to timely arrival at the place of work);
- women at the onset of pregnancy during registration in career centers as job seekers or unemployed;
- persons who have not served a full term at the place of initial distribution for valid reasons, including:
- dismissals in connection with the employment of the main employee when hiring to replace a temporarily absent employee (including the replacement of a temporary vacant public position);

Exemption from the obligation to work out is granted by the decision of the commission on the personal distribution of young specialists to the following categories of young specialists:
1) persons in the absence of vacancies in the locality at the place of residence, work or service of the spouse (spouse);
2) persons with disabilities of the first or second group;
3) persons enrolled for further study in residency, master's, doctoral studies on the basis of a state educational order;
4) pregnant women, persons who have, as well as independently raising a child (children) under the age of three years.![](/public/img/logo.png)

«Об образовании» (далее – Закон) и пункту 4 Правил направления молодых специалистов на работу, утвержденных постановлением Правительства Республики Казахстан от 30 марта 2012 года № 390 (далее – Правила), граждане, поступившие на обучение по педагогическим и медицинским специальностям на основе государственного образовательного заказа, обязаны отработать в организациях образования и организациях здравоохранения не менее трех лет после окончания организации высшего и (или) послевузовского образования. За неисполнение обязанности по отработке молодой специалист обязан возместить расходы, понесенные за счет бюджетных средств в связи с его обучением, в республиканский бюджет (п. 17-4 ст. 47 Закона).
В соответствии со ст.ст. 272 и 273 Гражданского кодекса Республики Казахстан (далее - ГК РК), обязательство должно исполняться надлежащим образом в соответствии с условиями обязательства, односторонний отказ от исполнения обязательства и одностороннее изменение его условий не допускаются.
В соответствии с п. 1 ст. 349 ГК РК, под нарушением обязательства понимается его неисполнение, либо исполнение ненадлежащим образом.
Согласно Закону и Правилам не предусмотрены нормы, определяющие перерасчет затраченных бюджетных средств в случае частичной отработки или рассрочки по возмещению бюджетных средств, связанных с обучением.
При этом, сумма за обучение складывается ежегодно постановлением Правительства Республики Казахстан средними расходами на обучение 1 студента за учебный год.

Подпунктом 3) пункта 17-2 статьи 47 Закона предусмотрено освобождение от обязанности по отработке лиц, поступивших для дальнейшего обучения в магистратуру, резидентуру, докторантуру (государственный грант).
В соответствии с частью 1 статьи 6 Гражданского кодекса Республики Казахстан нормы гражданского законодательства должны толковаться в соответствии с буквальным значением их словесного выражения.
Из смысла указанных норм Закона следует, что Комиссии имеют право освобождать молодых специалистов и докторов философии (PhD) от отработки только в случае поступления в магистратуру, резидентуру, докторантуру в год завершения обучения, но не в последующие годы, то есть при рассмотрении вопроса об освобождении от отработки в обязательном порядке должен учитываться фактор времени, а именно своевременности исполнения обязательств.
